Welcome to CapSkip. These Terms of Service govern your access to and use of the CapSkip software, website, services, updates, and related content provided by CapSkip Enterprise (“CapSkip”, “we”, “our”, or “us”).

By purchasing, downloading, installing, accessing, or using CapSkip, you agree to be bound by these Terms. If you do not agree, do not use CapSkip.

 

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use CapSkip. By using the service, you confirm that you meet these requirements.

2. Scope of Service

CapSkip is a desktop CAPTCHA-solving software product that supports image CAPTCHA solving, Google reCAPTCHA, Cloudflare Turnstile, and other supported CAPTCHA types depending on the license and product version.

We may modify, improve, add, suspend, or discontinue features at any time, with or without notice.

3. License Grant

Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use CapSkip according to the license type you purchased.

Your license is limited by the number of devices permitted under your selected plan. A device means one physical machine, VPS, or server instance unless otherwise stated.

This license is granted, not sold.

4. Lifetime License and Subscription Requirement

CapSkip is sold as a lifetime license with a one-time purchase fee. This lifetime license gives you the ongoing right to reactivate and use the purchased license tier in the future, subject to these Terms.

In addition to the one-time lifetime license purchase, an active monthly subscription fee is required to access and use CapSkip.

If you stop paying the monthly subscription fee, your access to CapSkip will be suspended or revoked until subscription payments resume. Your lifetime license is not cancelled by stopping the subscription. If you choose to use CapSkip again later, you may reactivate access by paying the then-current monthly subscription fee without purchasing a new lifetime license for the same tier, unless your prior license was terminated for violation of these Terms.

5. License Restrictions

You may not:

  • copy, resell, lease, sublicense, share, redistribute, or commercially exploit CapSkip except as expressly allowed by us

  • bypass, disable, or interfere with licensing, activation, authentication, usage restrictions, subscription controls, or security mechanisms

  • reverse engineer, decompile, disassemble, or attempt to extract the source code, models, or internal logic of CapSkip, except where such restriction is prohibited by law

  • use one license on more devices than your purchased plan allows

  • share account credentials or license access with third parties

  • modify, tamper with, or create derivative works based on CapSkip except where explicitly permitted

  • use the software in a way that violates any applicable law, regulation, platform policy, or third-party rights

6. Accounts and Credentials

Some features may require login credentials, license credentials, or API keys. You are responsible for maintaining the confidentiality of your account and access details and for all activity occurring under your credentials.

You must provide accurate information when purchasing or using CapSkip. We reserve the right to suspend or terminate access if we detect fraud, abuse, unauthorized sharing, chargeback abuse, or suspicious activity.

7. Payments and Pricing

Prices are listed on our website unless otherwise stated. By placing an order, you agree to pay the applicable fees for the selected plan.

Unless explicitly stated otherwise:

  • all payments are due in advance

  • prices may change at any time for future purchases or future subscription renewals

  • taxes, duties, or local fees may apply depending on your jurisdiction

  • the lifetime license purchase and the monthly subscription fee are separate charges

  • continued access requires an active subscription payment, even after the lifetime license has been purchased

If recurring billing is offered for any plan, you authorize us or our payment processor to charge the applicable fees according to the billing cycle shown at checkout.

8. Trial License

If a trial plan is offered, it is provided strictly for testing and evaluation. Trial licenses may include usage limits, reduced speed, time restrictions, feature limitations, or other constraints.

The trial license is offered so users can evaluate whether CapSkip meets their needs before committing to a lifetime license.

We reserve the right to modify or discontinue the trial offering at any time.

9. No Refund Policy

Because CapSkip is a digital software product with immediate access and downloadable delivery, all sales are final unless otherwise required by applicable law.

We do not offer refunds for purchased licenses or subscription payments. Users who want to evaluate the software before purchasing should use the available trial license.

10. Updates and Changes

We may release updates, patches, improvements, model changes, compatibility fixes, UI changes, security updates, and feature additions at our discretion.

Some updates may be required for continued functionality. We do not guarantee that older versions will remain compatible indefinitely with third-party services, websites, or anti-bot systems.

11. User Responsibility

You are solely responsible for:

  • how you use CapSkip

  • the systems, software, scripts, proxies, servers, and websites you connect to it

  • ensuring your use complies with applicable laws and contractual obligations

  • securing your machine, VPS, network, account credentials, and API keys

  • verifying that your usage is lawful in your jurisdiction and industry

You are also responsible for reviewing results before relying on them in any sensitive, automated, or production environment.

12. Acceptable Use

You agree not to use CapSkip for any unlawful, abusive, fraudulent, deceptive, or harmful activity.

You may not use CapSkip in connection with activities that violate website terms, evade legal restrictions, damage systems, abuse infrastructure, distribute malware, commit fraud, or infringe the rights of others.

We reserve the right to suspend or terminate access if we reasonably believe your use creates legal, operational, reputational, or security risk.

13. Performance Disclaimer

CapSkip is provided as a software tool, not as a guaranteed outcome service.

We do not guarantee:

  • uninterrupted availability

  • perfect accuracy

  • success on every CAPTCHA type

  • compatibility with every third-party application

  • acceptance of solved tokens by target websites

  • freedom from false positives, failed solves, bans, or rate limits

  • compatibility with all future CAPTCHA changes or anti-bot updates

Performance may vary based on your hardware, operating system, shipped software components, proxies, network quality, third-party software, target website logic, service changes, and other factors outside our control.

Any performance figures, success rates, speed claims, or compatibility statements shown on the website are general product descriptions, not warranties.

14. Proxy and Network Use

Some features require proxies or external network infrastructure. You are solely responsible for obtaining, configuring, and lawfully using your proxies, IP resources, servers, and network connections.

We are not responsible for bans, blocks, poor proxy quality, blacklisted IPs, DNS issues, firewall issues, or network failures.

15. Support

We may provide setup guidance, documentation, tutorials, troubleshooting, updates, or customer support at our discretion.

Support availability, scope, and response time are not guaranteed unless explicitly stated. We may refuse support in cases of abuse, hostile conduct, unsupported environments, modified binaries, pirated use, or behavior that makes assistance impractical.

16. Intellectual Property

CapSkip, including its software, branding, logos, models, documentation, design, UI, code, text, graphics, and related materials, is owned by CapSkip Enterprise or its licensors and is protected by intellectual property laws.

No rights are granted except those expressly stated in these Terms.

17. Feedback

If you provide suggestions, ideas, feature requests, bug reports, or other feedback, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, modify, reproduce, and incorporate that feedback without compensation or obligation to you.

18. Privacy

Your use of CapSkip is also subject to our Privacy Policy, available at: https://capskip.com/privacy-policy/.

By using CapSkip, you acknowledge that we may process account, licensing, technical, device, usage, and support-related information as described in that policy.

19. Suspension and Termination

We may suspend, restrict, or terminate your access at any time if:

  • you violate these Terms

  • your payment is reversed, disputed, or fraudulent

  • your license is shared, abused, or used beyond the permitted device count

  • we detect tampering, cracking, bypass attempts, or security abuse

  • continued access would create legal or operational risk

Upon termination, your license may be disabled and you must stop using CapSkip.

If access is suspended solely because your subscription is inactive, your lifetime license remains valid and may be reactivated later upon payment of the applicable subscription fee, unless the account or license was terminated for breach of these Terms.

Sections that by their nature should survive termination will continue to apply, including ownership, disclaimers, limitation of liability, indemnity, and dispute-related provisions.

20. Disclaimer of Warranties

CAPSKIP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, AVAILABLE AT ALL TIMES, OR SUITABLE FOR YOUR SPECIFIC NEEDS.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPSKIP ENTERPRISE, ITS OWNERS, AFFILIATES, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR SERVICE INTERRUPTIONS ARISING OUT OF OR RELATED TO YOUR USE OF CAPSKIP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO CAPSKIP SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SUBSCRIPTION GIVING RISE TO THE CLAIM.

22. Indemnification

You agree to defend, indemnify, and hold harmless CapSkip Enterprise, its affiliates, officers, owners, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your use or misuse of CapSkip

  • your violation of these Terms

  • your violation of any law, third-party right, or contractual obligation

  • your content, data, scripts, automation, proxies, infrastructure, or connected systems

23. Governing Law

These Terms are governed by the laws of Malaysia.

24. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or CapSkip shall be resolved exclusively in the courts of Malaysia, and you consent to the jurisdiction and venue of those courts, unless applicable law requires otherwise.

25. Changes to These Terms

We may update these Terms from time to time. If we do, we will post the revised version on this page and update the Last Modified date above. Your continued use of CapSkip after any update means you accept the revised Terms.
